1. Introduction

Welcome to Preirisoph Travel Pty Ltd (ABN: 12 345 678 901). These Terms of Service ("Terms") govern your use of our website located at preirisoph.com (the "Site") and all travel services provided by Preirisoph Travel ("we," "us," or "our").

By accessing our Site, making a booking, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Site or services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our Site. Your continued use of our Site or services after any such changes constitutes your acceptance of the new Terms.

2. Definitions

In these Terms, the following definitions apply:

  • "Booking" means the booking for travel arrangements or travel-related services made with us.
  • "Client" or "you" means any person who makes a Booking or purchases travel services from us.
  • "Travel Services" means any travel arrangements including, but not limited to, tours, flights, accommodation, transfers, activities, or other services arranged by us on your behalf.
  • "Service Provider" means any third-party provider of Travel Services, such as airlines, hotels, tour operators, or transportation companies.
  • "Confirmation" means our written confirmation of your Booking.
  • "Force Majeure Event" means any event beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, pandemics, natural disasters, or severe weather conditions.

3. Bookings and Payments

3.1 Making a Booking

To make a Booking, you must provide complete and accurate information as requested. By making a Booking, you warrant that you have the authority to accept these Terms on behalf of yourself and any other person included in the Booking.

3.2 Booking Confirmation

A contract between you and us is formed when we issue a Confirmation. Prior to this, all information provided to you, including prices and availability, is subject to change without notice.

3.3 Deposit Requirement

A non-refundable deposit of 25% of the total booking value is required to secure your Booking, unless otherwise specified. The balance of the payment must be paid no later than 60 days prior to departure.

3.4 Payment Methods

We accept payments via credit card (Visa, Mastercard, American Express), direct bank deposit, and other methods specified at the time of booking. Credit card payments may incur a surcharge of up to 1.5% depending on the card type.

3.5 Late Bookings

For bookings made within 60 days of departure, full payment is required at the time of booking.

4. Prices and Surcharges

4.1 Price Inclusions and Exclusions

All prices are quoted in Australian Dollars (AUD) including GST where applicable. Prices include only what is expressly stated in the Confirmation. Unless specifically mentioned, prices do not include travel insurance, passport and visa fees, vaccinations, additional meals, optional activities, gratuities, excess baggage charges, personal expenses, or any other items not specified.

4.2 Price Changes

Prices are subject to change due to factors beyond our control, including currency fluctuations, increases in taxes, fuel surcharges, or government action. If the total price of your Travel Services increases by more than 10% after your Booking is confirmed, you may cancel without paying cancellation fees and receive a full refund of all monies paid. This right must be exercised within 7 days of being notified of the price increase.

4.3 Errors and Omissions

While we make every effort to ensure the accuracy of the information and prices on our Site and in our materials, errors may occasionally occur. We reserve the right to correct any errors in pricing or descriptions and to cancel a Booking if we believe it contains a significant error. In such cases, we will offer you the option of a refund or an alternative Travel Service of comparable standard.

5. Changes and Cancellations

5.1 Changes by You

If you wish to change your Booking after it has been confirmed, we will make reasonable efforts to accommodate your request. A service fee of AUD $150 per person will apply, plus any additional costs imposed by Service Providers. Changes requested within 60 days of departure may be treated as a cancellation and rebooking, incurring cancellation fees as outlined in section 5.3.

5.2 Transferring a Booking

If you are unable to travel, you may transfer your Booking to another person who satisfies all the conditions applicable to the Booking, provided you notify us at least 30 days before departure. Both the original booker and the transferee remain jointly and severally liable for the payment of the balance due and for any additional costs arising from the transfer.

5.3 Cancellation by You

You may cancel your Booking at any time by written notice to us. Cancellation fees will apply as follows:

  • More than 60 days before departure: Loss of deposit
  • 60-30 days before departure: 50% of total booking value
  • 29-15 days before departure: 75% of total booking value
  • 14 days or less before departure: 100% of total booking value

These cancellation fees are in addition to any cancellation fees imposed by Service Providers. Some Travel Services, particularly airfares, may have different cancellation policies, which will be communicated at the time of booking.

5.4 Changes or Cancellations by Us

We reserve the right to make changes to your Travel Services if necessary. Minor changes (e.g., change in accommodation of similar standard) will not entitle you to a refund or compensation.

In the event of a significant change or cancellation by us for reasons other than Force Majeure, you will be offered the choice of:

  • Accepting the changed arrangements
  • Purchasing an alternative Travel Service of comparable standard, if available
  • Cancelling and receiving a full refund of all monies paid

5.5 Force Majeure

We will not be liable for any failure to perform our obligations under these Terms due to a Force Majeure Event. In the event of a Force Majeure Event affecting your Travel Services, we will notify you as soon as possible. We may offer alternative Travel Services or issue a credit for future use, but are not obligated to provide a refund for services not used due to a Force Majeure Event.

6. Travel Documents and Requirements

6.1 Passport and Visa Requirements

It is your responsibility to obtain and maintain valid passports, visas, permits, and any other documents required for your travel. Your passport must be valid for at least six months beyond your planned return date. We will provide general information about passport and visa requirements, but this information is subject to change and we do not warrant its accuracy.

6.2 Health Requirements

You must ensure compliance with all health requirements and recommendations for your travel destinations. This may include vaccinations, medical certificates, or health declarations. We recommend consulting with a travel medicine specialist well in advance of your departure.

6.3 Travel Advice

You acknowledge that you have been advised to check and monitor travel advisories issued by the Australian Department of Foreign Affairs and Trade (DFAT) at www.smartraveller.gov.au for your travel destinations.

7. Travel Insurance

We strongly recommend that you purchase comprehensive travel insurance at the time of booking. Your travel insurance should cover at minimum: trip cancellation and interruption, medical expenses, emergency evacuation, repatriation of remains, and loss, theft, or damage to baggage and personal effects.

By accepting these Terms, you acknowledge that we have advised you of the importance of travel insurance and that you understand the risks of traveling without adequate insurance coverage.

8. Liability and Limitations

8.1 Our Role

We act as an agent for Service Providers in arranging Travel Services. All Travel Services are provided by independent Service Providers over whom we have no direct control. We do not own, manage, control, or operate any transportation vehicle, hotel, restaurant, tour, or other service provider.

8.2 Limitation of Liability

To the maximum extent permitted by law, we exclude all liability for any loss, damage, injury, or illness (including death) that may be suffered by you or any third party arising from or in connection with the Travel Services or your use of our Site.

Where such exclusion is not permitted by law, our liability will be limited to the resupply of the Travel Services or the payment of the cost of having the Travel Services supplied again, at our option.

8.3 Service Provider Liability

All Travel Services are subject to the terms and conditions and limitations of liability imposed by the relevant Service Providers. By accepting these Terms, you acknowledge that the Service Providers' terms may limit or exclude liability in respect of death, personal injury, delay, and loss or damage to baggage.

8.4 Claims and Complaints

Any claims or complaints relating to your Travel Services must be notified to us in writing within 30 days after the completion of your travel. We cannot guarantee resolution of claims or complaints made after this time.

9. Health and Safety

By making a Booking, you confirm that you and all persons traveling with you are physically and mentally capable of undertaking the Travel Services and that your health or circumstances will not endanger yourself or others.

You must disclose any pre-existing medical conditions, disabilities, or special requirements at the time of booking. We will make reasonable efforts to accommodate special requirements, but cannot guarantee that all services will be accessible to all individuals.

For the safety and comfort of all travelers, we reserve the right to refuse a Booking or to remove anyone from a tour who, in our opinion, is likely to endanger the health or safety of themselves or others, or whose behavior is deemed to be detrimental to the enjoyment of the tour by others.

10. Website Usage and Intellectual Property

10.1 Intellectual Property

All content on our Site, including text, graphics, logos, images, audio clips, digital downloads, and data compilations, is the property of Preirisoph Travel or its content suppliers and is protected by Australian and international copyright laws. All software used on the Site is the property of Preirisoph Travel or its software suppliers and is protected by Australian and international copyright laws.

10.2 Permitted Use

You may view, download, and print content from our Site for your personal, non-commercial use only. You must not reproduce, republish, upload, post, transmit, or distribute any content from our Site in any way without our prior written permission.

10.3 User Conduct

You agree not to use our Site:

  • In any way that violates any applicable laws or regulations
  • To transmit any material that is defamatory, offensive, or otherwise objectionable
  • To impersonate or attempt to impersonate us, our employees, or other users
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site
  • To interfere with the proper working of the Site

10.4 Links to Third-Party Websites

Our Site may contain links to third-party websites. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or any loss or damage that may arise from your use of them.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or relating to these Terms or your use of our Site or services.
